Terms of Service

1. Acceptance of Terms

These Terms of Service (the "Terms") govern the relationship between Ninemomo (the "Operator") and the user regarding the use of the Trip Ember application (the "Service").

By installing or using the Service, you signify your agreement to be bound by these Terms. The Operator reserves the right to amend these Terms at any time in compliance with applicable laws. Amendments will be notified through service announcements or within the application interface.

2. Intellectual Property and Usage Restrictions

All intellectual property rights, including source code, designs, logos, and databases within the Service, remain the exclusive property of the Operator.

  • The Service is provided solely for personal travel planning and logging. Users may not commercially resell or reproduce any part of the Service without prior written consent from the Operator.
  • Attempting to reverse engineer, decompile, or extract the source code of the Service is strictly prohibited by law.
  • While the Service is primarily free to use, certain premium features are provided through paid (PRO) tiers. The Operator reserves the right to modify the feature set or pricing policies at its discretion.

3. Paid Services and Payment Policy

The following policies apply to the use of premium (PRO) services via in-app purchases:

• Grant of Access: PRO features are granted only upon successful authorization and verification through the Apple App Store or Google Play Store billing systems.

• Platform Compliance: All in-app purchases and refund procedures are governed primarily by the terms and policies of the respective App Store operators.

• Refund Notice: The Operator does not directly handle payment processing or possess refund authority. Users seeking refunds must apply directly through the respective store's (Apple/Google) customer support. Due to the nature of digital content, refunds may be restricted once features have been accessed.

• Lifetime Access Limitations: "PRO Lifetime" licenses are valid only for the duration that the Service remains operational and supported by the Operator. Access terminates automatically upon permanent discontinuation of the Service.

4. Device Management and Security Responsibility

Prohibition of Software Modification

Usage of the Service on "jailbroken" or "rooted" devices is strongly discouraged. The Operator shall not be held liable for data breaches, security vulnerabilities, or malfunctions arising from the use of compromised operating systems.

Network and Roaming Charges

The user is solely responsible for any data communication or roaming charges incurred during travel. The Operator assumes no liability for costs imposed by the user’s telecommunications provider.

5. Limitation of Liability and Disclaimers

The Operator strives for quality service but expressly disclaims liability in the following areas:

  • Data Accuracy: Currency exchange rates, venue information, and travel tips are provided by third-party data sources or generated by AI. The Operator does not guarantee accuracy and is not liable for any losses (financial or logistical) resulting from reliance on this data.
  • Data Loss: The user is responsible for performing backups. The Operator is not liable for data loss resulting from device theft, account loss, or application deletion.
  • Limitation of Damages: To the maximum extent permitted by applicable law, the Operator’s total liability for any claim arising out of the Service shall not exceed the actual amount paid by the user for the use of the Service (if any).

6. Artificial Intelligence (AI) Notice

This Service utilizes Artificial Intelligence technologies, including the Google Gemini API, to generate travel guides and summaries. AI may generate inaccurate, biased, or outdated information. All AI-generated content is provided for informational purposes only. The user assumes full responsibility for all decisions and safety precautions taken based on AI suggestions.

7. Service Updates and Discontinuation

The Operator reserves the right to update, modify, or discontinue any part of the Service without prior notice for technical or operational reasons. In the event of service termination, the Operator will provide notice via its website or the application interface, at which point all data access and licenses granted to the user will immediately expire.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea.

In the event of a dispute between the Operator and the user arising out of the use of the Service, both parties shall first attempt to resolve the issue in good faith. If a resolution cannot be reached and litigation ensues, the parties agree that the court having jurisdiction over the Operator’s place of business shall be the exclusive court of jurisdiction.
